1. Terms

By accessing the website at https://heinigeracademy.com.au, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Heiniger Academy's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials;

use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

attempt to decompile or reverse engineer any software contained on Heiniger Academy's website;

remove any copyright or other proprietary notations from the materials; or

transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Heiniger Academy at any time. Further, Heiniger Academy does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Heiniger Academy or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Heiniger Academy's website, even if Heiniger Academy or a Heiniger Academy authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on Heiniger Academy's website could include technical, typographical, or photographic errors. Heiniger Academy does not warrant that any of the materials on its website are accurate, complete or current. Heiniger Academy may make changes to the materials contained on its website at any time without notice. However Heiniger Academy does not make any commitment to update the materials.

Heiniger Academy has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Heiniger Academy of the site. Use of any such linked website is at the user's own risk.

7. Modifications

Heiniger Academy may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Western Australia and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

9. Petbarn Practical Course

If at any time during the Practical Course the Student breaches or does not comply with the Work Health and Safety and Animal Welfare policies the student may be asked to exit the course.

It is the responsibility of the student to complete the requirements of the accredited certification course. If the student is not able to complete any of the learning outcomes within the Practical Course due to absenteeism or other reason, Heiniger Academy will, to the best of its ability, endeavour to make alternative arrangements with the student but is not responsible for the completion of the certification requirements.

At any stage during the Practical Course the Student exits the course prior to the course finishing then Heiniger Academy will refund the Student a percentage of the Practical Course Fee component calculated by reference to the uncompleted portion of the course.

PRIVACY NOTICE

Heiniger Academy has a responsibility to collect, use and store personal and sensitive information on our students in compliance with the relevant laws and regulations:

  • Why we collect your personal information – as a registered training organisation (RTO), we collect your personal information so we can process and manage your enrolment in a vocational education and training (VET) course with us.
  • How we use your personal information – We use your personal information to enable us to deliver VET courses to you, and otherwise, as needed, to comply with our obligations as an RTO.
  • How we disclose of your personal information – we are required by law (under the National Vocational Education and Training Regulator Act 2011 (Cth) (NVETR Act)) to disclose the personal information we collect about you to the National VET Data Collection kept by the National Centre for Vocational Education Research Ltd (NCVER). The NCVER is responsible for collecting, managing, analysing and communicating research and statistics about the Australian VET sector. We are also authorised by law (under the NVETR Act) to disclose your personal information to the relevant state or territory training authority.
  • How the NCVER and other bodies handle your personal information – NCVER will collect, hold, use and disclose your personal information in accordance with the law, including the Privacy Act 1988 (Cth) (Privacy Act) and the NVETR Act. Your personal information may be used and disclosed by NCVER for purposes that include populating authenticated VET transcripts; administration of VET; facilitation of statistics and research relating to education, including surveys and data linkage; and understanding the VET market.
  • NCVER is authorised to disclose information to the Australian Government Department of Employment and Workplace Relations (DEWR), Commonwealth authorities, State and Territory authorities (other than registered training organisations) that deal with matters relating to VET and VET regulators for the purposes of those bodies, including to enable:
  • administration of VET, including program administration, regulation, monitoring and evaluation
  • facilitation of statistics and research relating to education, including surveys and data linkage
  • understanding how the VET market operates, for policy, workforce planning and consumer information.
  • NCVER may also disclose personal information to persons engaged by NCVER to conduct research on NCVER’s behalf. The NCVER does not intend to disclose your personal information to any overseas recipients.

  • If you would like to seek access to or correct your information, in the first instance, please contact your RTO using the contact details listed below.
  • DEWR is authorised by law, including the Privacy Act and the NVETR Act, to collect, use and disclose your personal information to fulfil specified functions and activities. For more information about how the DEWR will handle your personal information, please refer to the DEWR VET Data Privacy Notice here.
  • Surveys – you may receive a student survey which may be run by a government department or an NCVER employee, agent, third-party contractor or another authorised agency. Please note you may opt out of the survey at the time of being contacted.
  • Contact information – at any time, you may contact us at academy@heiniger.com.au to – request access to your personal information, correct your personal information, make a complaint about how your personal information has been handled and ask a question about this Privacy Notice. REFUND POLICY

Refunds will be issued under the following circumstances:

  • If the course is cancelled by Heiniger Academy.
  • If the participant provides written notice of withdrawal to Heiniger Academy at least ten (10) days before the course start date.
  • If a review process determines that the participant does not need to complete the course or specific components of it.

Partial refunds may be granted for any portion of the course not commenced by the student, minus any applicable administration fees. Refunds will not be provided after six (6) months from the commencement date of theory.

All approved refunds will be processed within five (5) working days of the student’s request.

Courses are planned based on a minimum number of participants. Heiniger Academy reserves the right to cancel or reschedule a course up to 48 hours before it is due to begin. In such cases, participants will receive a full refund of any fees paid or be offered an alternative course option.

Heiniger Academy ensures that refund funds are always available through sound financial practices. All fees and charges are managed in accordance with AQTF (Australian Quality Training Framework) requirements.

Heiniger Academy financial arrangements operate in such a way that refund moneys are always available. Fees and charges comply with the requirements identified in the AQTF.
